# §63.3522. How do I demonstrate continuous compliance with the emission limitations?

- (a) For each compliance period, to demonstrate continuous compliance, you must use no coating for which the organic HAP content, determined using Equation 1 of [§ 63.3521](/cfr/40/63.3521.md), exceeds the applicable emission limit in [§ 63.3490](/cfr/40/63.3490.md) and use no thinner that contains organic HAP, determined according to [§ 63.3521(a)](/cfr/40/63.3521.md?p=a). A compliance period consists of 12 months. Each month after the end of the initial compliance period described in [§ 63.3520](/cfr/40/63.3520.md) is the end of a compliance period consisting of that month and the preceding 11 months.
- (b) If you choose to comply with the emission limitations by using the compliant material option, the use of any coating or thinner that does not meet the criteria specified in [paragraph (a)](#a) of this section is a deviation from the emission limitations that must be reported as specified in §§ [63.3510(b)(6)](/cfr/40/63.3510.md?p=b-6) and [63.3511(a)(5)](/cfr/40/63.3511.md?p=a-5).
- (c) As part of each semiannual compliance report required by [§ 63.3511](/cfr/40/63.3511.md), you must identify the coating operation(s) for which you used the compliant material option. If there were no deviations from the emission limitations set forth in [§ 63.3490](/cfr/40/63.3490.md), submit a statement that the coating operation(s) was (were) in compliance with the emission limitations during the reporting period because you used no coating for which the organic HAP content exceeded the applicable emission limit in [§ 63.3490](/cfr/40/63.3490.md), and you used no thinner that contained organic HAP, as determined according to [§ 63.3521(a)](/cfr/40/63.3521.md?p=a).
- (d) You must maintain records as specified in §§ [63.3512](/cfr/40/63.3512.md) and [63.3513](/cfr/40/63.3513.md).
