# §63.1321. Batch process vents provisions.

- (a) **Batch process vents.** Except as specified in [paragraphs (b) through (d)](#b..d) of this section, owners and operators of new and existing affected sources with batch process vents shall comply with the requirements in [§§ 63.1322 through 63.1327](/cfr/40/63.1322..63.1327.md). The batch process vent group status shall be determined in accordance with [§ 63.1323](/cfr/40/63.1323.md). Owners or operators of batch process vents classified as Group 1 shall comply with the reference control technology requirements for Group 1 batch process vents in [§ 63.1322](/cfr/40/63.1322.md), the monitoring requirements in [§ 63.1324](/cfr/40/63.1324.md), the performance test methods and procedures to determine compliance in [§ 63.1325](/cfr/40/63.1325.md), the recordkeeping requirements in [§ 63.1326](/cfr/40/63.1326.md), and the reporting requirements in [§ 63.1327](/cfr/40/63.1327.md). Owners or operators of all Group 2 batch process vents shall comply with the applicable reference control technology requirements in [§ 63.1322](/cfr/40/63.1322.md), the applicable recordkeeping requirements in [§ 63.1326](/cfr/40/63.1326.md), and the applicable reporting requirements in [§ 63.1327](/cfr/40/63.1327.md).
- (b) **New SAN batch affected sources.** Owners and operators of new SAN affected sources using a batch process shall comply with the requirements of [§ 63.1322](/cfr/40/63.1322.md) through [§ 63.1327](/cfr/40/63.1327.md) for batch process vents and aggregate batch vent streams except as specified in [paragraphs (b)(1) through (b)(2)](#b-1..b-2) of this section. For continuous process vents, owners and operators shall comply with the requirements of [§ 63.1322](/cfr/40/63.1322.md) through [§ 63.1327](/cfr/40/63.1327.md) except as specified in [paragraph (b)(3)](#b-3) of this section.
  - (1) For batch process vents, the determination of group status (i.e., Group 1/Group 2) under [§ 63.1323](/cfr/40/63.1323.md) is not required.
  - (2) For batch process vents and aggregate batch vent streams, the control requirements for individual batch process vents or aggregate batch vent streams (e.g., 90 percent emission reduction) as specified in § [63.1322(a)(1)](/cfr/40/63.1322.md?p=a-1), [(a)(2)](/cfr/40/63.1322.md?p=a-2), [(b)(1)](/cfr/40/63.1322.md?p=b-1), and [(b)(2)](/cfr/40/63.1322.md?p=b-2) shall not apply.
  - (3) Continuous process vents using a control or recovery device to comply with [§ 63.1322(a)(3)](/cfr/40/63.1322.md?p=a-3) are subject to the applicable requirements in [§ 63.1315(a)](/cfr/40/63.1315.md?p=a), as appropriate, except as specified in paragraphs [(b)(3)(i)](#b-3-i) and [(b)(3)(ii)](#b-3-ii) of this section.
    - (i) Said continuous process vents are not subject to the group determination procedures of [§ 63.115](/cfr/40/63.115.md) for the purposes of this subpart.
    - (ii) Said continuous process vents are not subject to the reference control technology provisions of [§ 63.113](/cfr/40/63.113.md) for the purposes of this subpart.
- (c) **Aggregate batch vent streams.** Aggregate batch vent streams, as defined in [§ 63.1312](/cfr/40/63.1312.md), are subject to the control requirements specified in [§ 63.1322(b)](/cfr/40/63.1322.md?p=b), as well as the monitoring, testing, recordkeeping, and reporting requirements specified in [§§ 63.1324 through 63.1327](/cfr/40/63.1324..63.1327.md) for aggregate batch vent streams.
- (d) Owners and operators of affected sources producing ASA/AMSAN shall comply with the provisions of [§ 63.1315(e)](/cfr/40/63.1315.md?p=e).
