# §63.11469. What are the notification requirements?

- (a) You must submit the Initial Notification required by [§ 63.9(b)(2)](/cfr/40/63.9.md?p=b-2) no later than 120 days after the applicable compliance date specified in [§ 63.11464](/cfr/40/63.11464.md), or no later than 120 days after the source becomes subject to this subpart, whichever is later. The Initial Notification must include the information specified in [§ 63.9(b)(2)(i) through (iv)](/cfr/40/63.9.md?p=b-2-i..b-2-iv) and may be combined with the Notification of Compliance Status required in [§ 63.11467](/cfr/40/63.11467.md) and [paragraph (b)](#b) of this section if you choose to submit both notifications within 120 days.
- (b) You must submit a Notification of Compliance Status in accordance with [§ 63.9(h)](/cfr/40/63.9.md?p=h) and the requirements in paragraphs [(c)](#c) and [(d)](#d) of this section. In addition to the information required in §§ [63.9(h)(2)](/cfr/40/63.9.md?p=h-2), [63.11466](/cfr/40/63.11466.md), and [63.11467](/cfr/40/63.11467.md), your notification must include the following certification(s) of compliance, as applicable, and signature of a responsible official:
  - (1) This certification of compliance by the owner or operator of an existing affected source who is relying on a previous performance test: “This facility complies with the control efficiency requirement [or the outlet concentration limit] in [§ 63.11465](/cfr/40/63.11465.md) based on a previous performance test in accordance with [§ 63.11466](/cfr/40/63.11466.md).”
  - (2) **This certification of compliance by the owner or operator of any new or existing affected source—** “This facility has conducted an initial inspection of each control device according to the requirements in [§ 63.11467](/cfr/40/63.11467.md), will conduct periodic inspections and maintenance of control devices in accordance with [§ 63.11468](/cfr/40/63.11468.md), and will maintain records of each inspection and maintenance action required by [§ 63.11470](/cfr/40/63.11470.md).”
  - (3) **This certification of compliance by the owner or operator of a new affected source—** “This facility has an approved bag leak detection system monitoring plan in accordance with [§ 63.11468(c)(2)](/cfr/40/63.11468.md?p=c-2).”
- (c) If you own or operate an affected source and are required to conduct a performance test under [§ 63.11466](/cfr/40/63.11466.md), you must submit a Notification of Compliance Status, including the performance test results, before the close of business on the 60th day following the completion of the performance test.
- (d) If you own or operate an affected source and are not required to conduct a performance test under [§ 63.11466](/cfr/40/63.11466.md), you must submit a Notification of Compliance Status, including the results of the previous performance test, no later than 120 days after the applicable compliance date specified in [§ 63.11464](/cfr/40/63.11464.md).
