# §63.11193. Am I subject to this subpart?


You are subject to this subpart if you own or operate an industrial, commercial, or institutional boiler as defined in [§ 63.11237](/cfr/40/63.11237.md) that is located at, or is part of, an area source of hazardous air pollutants (HAP), as defined in [§ 63.2](/cfr/40/63.2.md), except as specified in [§ 63.11195](/cfr/40/63.11195.md).
