# §62.6613. Identification of plan—negative declaration.


The Montana Department of Environmental Quality certified in a letter dated February 14, 2001, that there are no phosphate fertilizer plants in Montana that meet the definition of affected facility under any of the subparts [T](/cfr/40/subpartT.md), [U](/cfr/40/subpartU.md), V, W or X. Additionally, there are no phosphate fertilizer plants in Montana that meet the definition of affected facility under any of the subparts [T](/cfr/40/subpartT.md), [U](/cfr/40/subpartU.md), V, W, or X, constructed before October 22, 1974, and that have not reconstructed or modified since 1974.
