# §62.16035. Am I required to apply for and obtain a title V operating permit for my existing SSI unit?


Yes, if you are subject to an applicable EPA-approved and effective CAA [section 111(d)](/cfr/40/111.md?p=d)/129 state or tribal plan or an applicable and effective federal plan, you are required to apply for and obtain a title V operating permit for your existing SSI unit unless you meet the relevant requirements for an exemption specified in [§ 62.15860](/cfr/40/62.15860.md).
