# §62.15855. Am I subject to this subpart?

- (a) You are subject to this subpart if your SSI unit meets all three criteria described in [paragraphs (a)(1) through (3)](#a-1..a-3) of this section.
  - (1) **You own or operate an SSI unit(s) that commenced construction on or before October 14, 2010.**
  - (2) You own or operate an SSI unit(s) that meet the definition of an SSI unit as defined in [§ 62.16045](/cfr/40/62.16045.md).
  - (3) You own or operate an SSI unit(s) not exempt under [§ 62.15860](/cfr/40/62.15860.md).
- (b) If you own or operator an SSI unit(s) and make changes that meet the definition of modification after September 21, 2011, the SSI unit becomes subject to [40 CFR part 60](/cfr/40/part60.md), [subpart LLLL](/cfr/40/subpartLLLL.md), and the federal plan no longer applies to that unit.
- (c) If you own or operate an SSI unit(s) and make physical or operational changes to the SSI unit(s) for which construction commenced on or before September 21, 2011 primarily to comply with the federal plan, [40 CFR part 60](/cfr/40/part60.md), [subpart LLLL](/cfr/40/subpartLLLL.md), does not apply to the unit(s). Such changes do not qualify as modifications under [40 CFR part 60](/cfr/40/part60.md), subpart LLLL.
