# §61.56. Delegation of authority.

- (a) In delegating implementation and enforcement authority to a State under section 112(d) of the Act, the authorities contained in [paragraph (b)](#b) of this section shall be retained by the Administrator and not transferred to a State.
- (b) Authorities which will not be delegated to States: Sections [61.53(c)(4)](/cfr/40/61.53.md?p=c-4) and [61.55(d)](/cfr/40/61.55.md?p=d). The authorities not delegated to States listed are in addition to the authorities in the General Provisions, [subpart A](/cfr/40/subpartA.md) of [40 CFR part 61](/cfr/40/part61.md), that will not be delegated to States (§§ [61.04(b)](/cfr/40/61.04.md?p=b), [61.12(d)(1)](/cfr/40/61.12.md?p=d-1), and [61.13(h)(1)(ii)](/cfr/40/61.13.md?p=h-1-ii)).
