# §61.240. Applicability and designation of sources.

- (a) The provisions of this subpart apply to each of the following sources that are intended to operate in volatile hazardous air pollutant (VHAP) service: pumps, compressors, pressure relief devices, sampling connection systems, open-ended valves or lines, valves, connectors, surge control vessels, bottoms receivers, and control devices or systems required by this subpart.
- (b) The provisions of this subpart apply to the sources listed in [paragraph (a)](#a) after the date of promulgation of a specific subpart in [part 61](/cfr/40/part61.md).
- (c) While the provisions of this subpart are effective, a source to which this subpart applies that is also subject to the provisions of [40 CFR part 60](/cfr/40/part60.md) only will be required to comply with the provisions of this subpart.
- (d) **Alternative means of compliance—**
  - (1) **Option to comply with part 65.** Owners or operators may choose to comply with [40 CFR part 65](/cfr/40/part65.md) to satisfy the requirements of [§§ 61.242-1 through 61.247](/cfr/40/61.242-1..61.247.md) for equipment that is subject to this subpart and that is part of the same process unit. When choosing to comply with [40 CFR part 65](/cfr/40/part65.md), the requirements of §§ [61.245(d)](/cfr/40/61.245.md?p=d) and [61.246(i)](/cfr/40/61.246.md?p=i) and [(j)](/cfr/40/61.246.md?p=j) still apply. Other provisions applying to owners or operators who choose to comply with [40 CFR part 65](/cfr/40/part65.md) are provided in [40 CFR 65.1](/cfr/40/65.1.md).
  - (2) **Part 65, subpart C or F.** For owners or operators choosing to comply with [40 CFR part 65](/cfr/40/part65.md), each surge control vessel and bottoms receiver subject to this subpart that meets the conditions specified in table 1 or table 2 of this subpart shall meet the requirements for storage vessels in [40 CFR part 65](/cfr/40/part65.md), [subpart C](/cfr/40/subpartC.md); all other equipment subject to this subpart shall meet the requirements in [40 CFR part 65](/cfr/40/part65.md), subpart F.
  - (3) **Part 61, subpart A.** Owners or operators who choose to comply with [40 CFR part 65](/cfr/40/part65.md), subpart [C](/cfr/40/subpartC.md) or [F](/cfr/40/subpartF.md), must also comply with §§ [61.01](/cfr/40/61.01.md), [61.02](/cfr/40/61.02.md), [61.05 through 61.08](/cfr/40/61.05..61.08.md), [61.10(b) through (d)](/cfr/40/61.10.md?p=b..d), [61.11](/cfr/40/61.11.md), and [61.15](/cfr/40/61.15.md) for that equipment. All sections and paragraphs of [subpart A](/cfr/40/subpartA.md) of this part that are not mentioned in this [paragraph (d)(3)](#d-3) do not apply to owners or operators of equipment subject to this subpart complying with [40 CFR part 65](/cfr/40/part65.md), subpart [C](/cfr/40/subpartC.md) or [F](/cfr/40/subpartF.md), except that provisions required to be met prior to implementing [40 CFR part 65](/cfr/40/part65.md) still apply. Owners and operators who choose to comply with [40 CFR part 65](/cfr/40/part65.md), subpart [C](/cfr/40/subpartC.md) or [F](/cfr/40/subpartF.md), must comply with [40 CFR part 65](/cfr/40/part65.md), subpart A.
  - (4) **Rules referencing this subpart.** Owners or operators referenced to this subpart from subpart [F](/cfr/40/subpartF.md) or [J](/cfr/40/subpartJ.md) of this part may choose to comply with [40 CFR part 65](/cfr/40/part65.md) for all equipment listed in [paragraph (a)](#a) of this section.
