# §60.5710. What authorities to enforce these federal new source performance standards can the Administrator delegate to a state agency?

- (a) The U.S. EPA Administrator retains the following authorities which are not transferred to a state:
  - (1) Approval of exemption claims in § [60.5700(a)](/cfr/40/60.5700.md?p=a), [(b)](/cfr/40/60.5700.md?p=b), [(c)](/cfr/40/60.5700.md?p=c), [(d)](/cfr/40/60.5700.md?p=d), [(g)](/cfr/40/60.5700.md?p=g), and [(h)](/cfr/40/60.5700.md?p=h).
  - (2) Enforceability under federal law of the federally enforceable (as defined in [§ 60.6145](/cfr/40/60.6145.md)) permits specified in § [60.5700(a)](/cfr/40/60.5700.md?p=a) and [(g)](/cfr/40/60.5700.md?p=g).
  - (3) Determination of compliance with the siting requirements as specified in [§ 60.5790](/cfr/40/60.5790.md).
  - (4) Acceptance of relationship between carbon dioxide and oxygen as part of initial and annual performance tests as specified in §§ [60.6080(g)](/cfr/40/60.6080.md?p=g) and [60.6090(k)](/cfr/40/60.6090.md?p=k).
  - (5) Approval of other monitoring systems used to obtain emissions data when data is not obtained by CEMS as specified in §§ [60.5955](/cfr/40/60.5955.md) and [60.5985(g)(11)](/cfr/40/60.5985.md?p=g-11).
  - (6) Approval of a site-specific monitoring plan for the continuous emission monitoring system specified in § [60.5985(c)](/cfr/40/60.5985.md?p=c) and [(d)](/cfr/40/60.5985.md?p=d) or the continuous automated sampling system specified in § [60.5985(g)(10)](/cfr/40/60.5985.md?p=g-10) and [(h)](/cfr/40/60.5985.md?p=g-h) of this section.
  - (7) **Approval of major alternatives to test methods.**
  - (8) **Approval of major alternatives to monitoring.**
  - (9) **Waiver of recordkeeping.**
  - (10) Performance test and data reduction waivers under [§ 60.8(b)](/cfr/40/60.8.md?p=b).
  - (11) **Approval of an alternative to any electronic reporting to the EPA required by this subpart.**
- (b) The Administrator can delegate all other authorities in all other sections of this subpart to the state for direct state enforcement.
