# §60.4340a. How do I demonstrate compliance with my NO X emissions standard without using a NO X CEMS if I do not use water or steam injection?

- (a) If you qualify and elect to demonstrate continuous compliance according to the provisions of [§ 60.4333a(c)(2)](/cfr/40/60.4333a.md?p=c-2), you must demonstrate compliance with the NOX emissions standard using one of the methods specified in [paragraphs (a)(1) through (3)](#a-1..a-3) of this section.
  - (1) Conduct performance tests according to requirements in [§ 60.4400a](/cfr/40/60.4400a.md);
  - (2) Monitor the NOX emissions rate using the methodology in appendix E to [part 75](/cfr/40/part75.md) of this chapter, or the low mass emissions methodology in [§ 75.19](/cfr/40/75.19.md) of this chapter; or
  - (3) Install, calibrate, maintain, and operate an operating parameter continuous monitoring system according to the requirements specified in [paragraph (b)](#b) of this section and consistent with the requirements specified in [§ 60.4342a](/cfr/40/60.4342a.md).
- (b) If you opt to demonstrate compliance according to the procedures described in [paragraph (a)(3)](#a-3) of this section, continuous operating parameter monitoring must be performed using the methods specified in [paragraphs (b)(1) through (4)](#b-1..b-4) of this section as applicable to the stationary combustion turbine.
  - (1) Selection of the operating parameters used to comply with this [paragraph (b)](#b) must be identified in the performance test report. The selection of operating parameters is subject to the review and approval of the Administrator or delegated authority.
  - (2) For a lean premix stationary combustion turbine, you must continuously monitor the appropriate parameters to determine whether the unit is operating in low-NOX mode during periods when low-NOX operation is required to comply with the applicable emission NOX standard.
  - (3) For a stationary combustion turbine other than a lean premix stationary combustion turbine, you must define parameters indicative of the unit's NOX formation characteristics and monitor these parameters continuously.
  - (4) You must perform the parametric monitoring described in [section 2.3](/cfr/40/2.3.md) in appendix E to [part 75](/cfr/40/part75.md) of this chapter or in [§ 75.19(c)(1)(iv)(H)](/cfr/40/75.19.md?p=c-1-iv-H) of this chapter.
