# §60.2990. What Authorities are withheld by EPA?


The following authorities are withheld by the EPA and not transferred to the state, local or Tribal authority:

- (1) The authority to approve alternatives to the emission limitations in tables 2 and 2a to this subpart and operating limits established under [§ 60.3023](/cfr/40/60.3023.md) and table 3 to this subpart.
- (2) The authority to approve petitions for specific operating limits in accordance with the requirements in [§ 60.3024](/cfr/40/60.3024.md).
- (3) The authority of the Administrator to receive and grant petitions under [§ 60.8(b)(3)](/cfr/40/60.8.md?p=b-3) to approve of major alternatives to test methods in [§ 60.3027](/cfr/40/60.3027.md).
- (4) The authority to approve major alternatives to monitoring in [§§ 60.3038 through 60.3044](/cfr/40/60.3038..60.3044.md).
- (5) The authority to approve major alternatives to recordkeeping and reporting in [§§ 60.3046 through 60.3057](/cfr/40/60.3046..60.3057.md).
- (6) The authority to receive the required notices and to approve continued operation in connection with the status report requirements in [§ 60.3020(c)(2)](/cfr/40/60.3020.md?p=c-2).
- (7) The authority of the Administrator to receive and grant petitions under [§ 60.11(e)(6) through (8)](/cfr/40/60.11.md?p=e-6..e-8) to adjust opacity standards and establish opacity standards in accordance with [§ 60.3022](/cfr/40/60.3022.md) and [§§ 60.3066 through 60.3068](/cfr/40/60.3066..60.3068.md).
- (8) The authority of the Administrator under [§ 60.8(b)(4)](/cfr/40/60.8.md?p=b-4) to waive performance test and [§ 60.8(b)(5)](/cfr/40/60.8.md?p=b-5) to approve shorter sampling times or smaller sample volumes.
- (9) The authority to approve an alternative to any electronic reporting to the EPA required by this subpart.
