# §60.2927. How do I demonstrate initial compliance with the emission limitations and establish the operating limits?

- (a) Except as provided in [paragraph (b)](#b) of this section, you must conduct an initial performance test, as required under [§ 60.8](/cfr/40/60.8.md), to determine compliance with the emission limitations in table 1, 1a, or 1b to this subpart and to establish operating limits using the procedures in [§ 60.2916](/cfr/40/60.2916.md) or [§ 60.2917](/cfr/40/60.2917.md). The initial performance test must be conducted using the test methods listed in table 1, 1a, or 1b to this subpart and the procedures in [§ 60.2922](/cfr/40/60.2922.md). In the event of any conflict between [§ 60.8](/cfr/40/60.8.md) and the provisions of this subpart, the provisions of this subpart shall apply.
- (b) For very small municipal waste combustion units and institutional waste incineration units with a capacity less than or equal to 10 tons per day, you must demonstrate initial compliance according to [paragraph (a)](#a) of this section, unless you comply with the requirements for the substitute means of compliance demonstration in [§ 60.2929](/cfr/40/60.2929.md).
- (c) For each OSWI unit with a capacity greater than 10 tons per day, as an alternative to conducting a performance test under [paragraph (a)](#a) of this section for carbon monoxide, you may use a 12-hour rolling average of the 1-hour arithmetic average CEMS data to determine compliance with the emission limitations in tables 1, 1a, and 1b to this subpart. The initial performance evaluation required by [§ 60.2940(b)](/cfr/40/60.2940.md?p=b) must be conducted prior to collecting CEMS data that will be used for the initial compliance demonstration.
