# §60.1375. What reports must I submit before I submit my notice of construction?

- (a) If you are required to submit an application for a construction permit under [40 CFR part 51](/cfr/40/part51.md), subpart [I](/cfr/40/subpartI.md), or [40](/cfr/40/subpart40.md) CFR [part 52](/cfr/40/part52.md), you must submit five items by the date you submit your application.
  - (1) Your draft materials separation plan, as specified in [§ 60.1065](/cfr/40/60.1065.md).
  - (2) Your revised materials separation plan, as specified in [§ 60.1085(c)](/cfr/40/60.1085.md?p=c).
  - (3) Your notice of the initial public meeting for your draft materials separation plan, as specified in [§ 60.1070(b)](/cfr/40/60.1070.md?p=b).
  - (4) A transcript of the initial public meeting, as specified in [§ 60.1080(f)](/cfr/40/60.1080.md?p=f).
  - (5) The document that summarizes your responses to the public comments you received during the initial public comment period, as specified in [§ 60.1085(a)](/cfr/40/60.1085.md?p=a).
- (b) If you are not required to submit an application for a construction permit under [40 CFR part 51](/cfr/40/part51.md), subpart [I](/cfr/40/subpartI.md), or [40](/cfr/40/subpart40.md) CFR [part 52](/cfr/40/part52.md), you must submit the items in [paragraph (a)](#a) of this section with your notice of construction.
