# §455.60. Applicability; description of repackaging of agricultural pesticides performed by refilling establishments subcategory.

- (a) The provisions of this subpart are applicable to discharges resulting from all repackaging of agricultural pesticides performed by refilling establishments, as defined in [§ 455.10](/cfr/40/455.10.md); whose primary business is wholesale or retail sales; and where no pesticide manufacturing, formulating or packaging occurs, except as provided in paragraphs [(b)](#b), [(c)](#c) and [(d)](#d) of this section.
- (b) The provisions of this subpart do not apply to wastewater discharges from custom application or custom blending, as defined in [40 CFR 167.3](/cfr/40/167.3.md).
- (c) **The provisions of this subpart do not apply to wastewater discharges from—** the operation of employee showers and laundry facilities; the testing of fire protection equipment; the testing and emergency operation of safety showers and eye washes; or storm water.
- (d) The provisions of this subpart do not apply to wastewater discharges from the repackaging of microorganisms or Group 1 Mixtures, as defined under [§ 455.10](/cfr/40/455.10.md), or non-agricultural pesticide products.
