# §438.15. New source performance standards (NSPS).


New point sources subject to this subpart must achieve the new source performance standards (NSPS) for TSS, O&G (as HEM), and pH, which are the same as the corresponding limitation specified at [§ 438.12](/cfr/40/438.12.md). The performance standards apply with respect to each new point source that commences discharge after June 12, 2003.
