# §35.688. Award limitations.

- (a) **Initial grants.** The Regional Administrator will not make an initial award unless the Tribe or each member of the Intertribal Consortium has:
  - (1) Met the requirements of [§ 35.676](/cfr/40/35.676.md) (Eligible recipients); and
  - (2) Established an approved underground water source protection program or agrees to establish an approvable program within four years of the initial award.
- (b) **Subsequent grants.** The Regional Administrator will not make a subsequent grant, after the initial award, unless the Tribe can demonstrate reasonable progress towards assuming primary enforcement responsibility within the four-year period after initial award. After the four-year period expires, the Regional Administrator shall not award [section 1443(b)](/cfr/40/1443.md?p=b) funds to an Indian Tribe unless the Tribe has assumed primary enforcement responsibility for the underground water source protection program.
