# §35.418. Award limitations.


The following limitations apply to funds awarded under [section 205(j)(2)](/cfr/40/205.md?p=j-2) of the Clean Water Act. The Regional Administrator will not award these grants to a State agency:

- (a) Unless the agency develops its work plan jointly with local, regional and interstate agencies and gives funding priority to such agencies and designated or undesignated public comprehensive planning organizations to carry out portions of that work plan.
- (b) Unless the agency reports annually on the nature, extent, and causes of water quality problems in various areas of the State and interstate region.
- (c) Unless the work plan submitted with the application shows that the activities to be funded are coordinated, as appropriate, with activities proposed for funding under [section 106](/cfr/40/106.md) (Water Pollution Control) of the Clean Water Act.
