# §261.140. Applicability.

- (a) The requirements of this subpart apply to owners or operators of reclamation and intermediate facilities managing hazardous secondary materials excluded under [40 CFR § 261.4(a)(24)](/cfr/40/261.4.md?p=a-24), except as provided otherwise in this section.
- (b) States and the Federal government are exempt from the financial assurance requirements of this subpart.
