# §261.1080. Applicability.

- (a) The regulations in this subpart apply to tanks and containers that contain hazardous secondary materials excluded under the remanufacturing exclusion at [§ 261.4(a)(27)](/cfr/40/261.4.md?p=a-27), unless the tanks and containers are equipped with and operating air emission controls in accordance with the requirements of an applicable Clean Air Act regulations codified under [40 CFR part 60](/cfr/40/part60.md), [part 61](/cfr/40/part61.md), or [part 63](/cfr/40/part63.md).
