# §17.2. Definitions.


As used in this part:

- (a) The Act means [section 504](/usc/5/504.md) of title 5 U.S.C., as amended by [section 203(a)(1)](/cfr/40/203.md?p=a-1) of the Equal Access to Justice Act, Public Law No. 96-481.
- (b) Administrator means the Administrator of the Environmental Protection Agency.
- (c) Adversary adjudication means an adjudication required by statute to be held pursuant to [5 U.S.C. 554](/usc/5/554.md) in which the position of the United States is represented by counsel or otherwise, but excludes an adjudication for the purpose of granting or renewing a license.
- (d) EPA means the Environmental Protection Agency, an Agency of the United States.
- (e) Presiding officer means the official, without regard to whether he is designated as an administrative law judge or a hearing officer or examiner, who presides at the adversary adjudication.
- (f) Proceeding means an adversary adjudication as defined in [§ 17.2(b)](#b).
