# §124.57. Public notice.

- (a) **Section 316(a) requests (applicable to State programs, see § 123.25).** In addition to the information required under [§ 124.10(d)(1)](/cfr/40/124.10.md?p=d-1), public notice of an NPDES draft permit for a discharge where a CWA [section 316(a)](/cfr/40/316.md?p=a) request has been filed under [§ 122.21(l)](/cfr/40/122.21.md?p=l) shall include:
  - (1) A statement that the thermal component of the discharge is subject to effluent limitations under CWA section [301](/cfr/40/301.md) or [306](/cfr/40/306.md) and a brief description, including a quantitative statement, of the thermal effluent limitations proposed under section [301](/cfr/40/301.md) or [306](/cfr/40/306.md);
  - (2) A statement that a [section 316(a)](/cfr/40/316.md?p=a) request has been filed and that alternative less stringent effluent limitations may be imposed on the thermal component of the discharge under [section 316(a)](/cfr/40/316.md?p=a) and a brief description, including a quantitative statement, of the alternative effluent limitations, if any, included in the request; and
  - (3) If the applicant has filed an early screening request under [§ 125.72](/cfr/40/125.72.md) for a [section 316(a)](/cfr/40/316.md?p=a) variance, a statement that the applicant has submitted such a plan.
