# §1090.210. Benzene standards.


Except as specified in subpart G of this part, all gasoline is subject to the following benzene standards:

- (a) **Benzene average standard.** A gasoline manufacturer must meet a benzene average standard of 0.62 volume percent for each compliance period.
- (b) **Maximum benzene average standard.** A gasoline manufacturer must meet a maximum benzene average standard of 1.30 volume percent without the use of credits for each compliance period.
- (c) **Benzene standard for importers that import gasoline by rail or truck.**
  - (1) An importer that imports gasoline by rail or truck under [§ 1090.1610](/cfr/40/1090.1610.md) must comply with a benzene per-gallon standard of 0.62 volume percent instead of the standards specified in paragraphs [(a)](#a) and [(b)](#b) of this section.
  - (2) An importer that imports gasoline by rail or truck that does not comply with the alternative sampling and testing requirements in [§ 1090.1610](/cfr/40/1090.1610.md) must conduct sampling, testing, and sample retention in accordance with [subpart N](/cfr/40/subpartN.md) of this part and comply with the benzene standards in paragraphs [(a)](#a) and [(b)](#b) of this section.
