# §1054.5. Which nonroad engines are excluded from this part's requirements?


This part does not apply to the following nonroad engines:

- (a) Engines that are certified to meet the requirements of [40 CFR part 1051](/cfr/40/part1051.md) (for example, engines used in snowmobiles and all-terrain vehicles). Engines that are otherwise subject to [40 CFR part 1051](/cfr/40/part1051.md) but not required to be certified (such as engines exempted under [40 CFR part 1051](/cfr/40/part1051.md)) are also excluded from this part 1054, unless the regulations in [40 CFR part 1051](/cfr/40/part1051.md) specifically require them to comply with the requirements of this part 1054.
- (b) Engines that are certified to meet the requirements of [40 CFR part 1048](/cfr/40/part1048.md), subject to the provisions of [§ 1054.615](/cfr/40/1054.615.md).
- (c) **Propulsion marine engines.** See 40 CFR parts [91](/cfr/40/part91.md) and [1045](/cfr/40/part1045.md). Note that the evaporative emission standards of this part also do not apply with respect to auxiliary marine engines as described in [§ 1054.20](/cfr/40/1054.20.md).
- (d) **Engines used in reduced-scale models of vehicles that are not capable of transporting a person.**
