# §1036.815. Confidential information.

- (a) The provisions of 40 CFR [1068.10](/cfr/40/1068.10.md) and [1068.11](/cfr/40/1068.11.md) apply for information you submit under this part.
- (b) Emission data or information that is publicly available cannot be treated as confidential business information as described in [40 CFR 1068.11](/cfr/40/1068.11.md). Data that vehicle manufacturers need for demonstrating compliance with standards, including fuel-consumption data as described in §§ [1036.535](/cfr/40/1036.535.md) and [1036.545](/cfr/40/1036.545.md), also qualify as emission data for purposes of confidentiality determinations.
