# §21.13. Nonstatutory protests.

- (a) GAO will consider protests concerning awards of subcontracts by or for a Federal agency, sales by a Federal agency, or procurements by agencies of the government other than Federal agencies as defined in [§ 21.0(c)](/cfr/4/21.0.md?p=c) if the agency involved has agreed in writing to have protests decided by GAO.
- (b) The provisions of this part shall apply to nonstatutory protests except for:
  - (1) Section [21.8(d)](/cfr/4/21.8.md?p=d) and [(e)](/cfr/4/21.8.md?p=e) pertaining to recommendations for the payment of costs; and
  - (2) [Section 21.6](/cfr/4/21.6.md) pertaining to the withholding of award and the suspension of contract performance pursuant to 31 U.S.C. [3553(c)](/usc/31/3553.md?p=c) and [(d)](/usc/31/3553.md?p=d).
