# §3045.5. Commission action.

- (a) The Commission shall review the Postal Service notice together with any comments for initial compliance with the statutory requirements of [39 U.S.C. 3641](/usc/39/3641.md), and:
  - (1) Find that the market test is consistent with the requirements of [39 U.S.C. 3641](/usc/39/3641.md);
  - (2) Find that the market test is inconsistent with the requirements of [39 U.S.C. 3641](/usc/39/3641.md) and provide an opportunity to correct the identified deficiencies;
  - (3) Find that the market test is inconsistent with the requirements of [39 U.S.C. 3641](/usc/39/3641.md) and order that the market test not go into effect; or
  - (4) Direct other action as the Commission may consider appropriate.
