# §291.28. Civil penalty.

- (a) A person who violates any prohibition contained in this Part or permit issued under this Part may be assessed a penalty by the Authorized Officer after the person is given notice and opportunity for a hearing with respect to the violation, as provided in §§ [291.30](/cfr/36/291.30.md) and [291.31](/cfr/36/291.31.md).
- (b) **Each violation is considered a separate offense.**
