# §2.33. Report of injury or damage.

- (a) A person involved in an incident resulting in personal injury or property damage exceeding $300, other than an accident reportable under §§ [3.4](/cfr/36/3.4.md) or [4.4](/cfr/36/4.4.md) of this chapter, shall report the incident to the superintendent as soon as possible. This notification does not satisfy reporting requirements imposed by applicable State law.
- (b) **Failure to report an incident in accordance with paragraph (a) of this section is prohibited.**
