# §75.740. Protection of and access to student records; student rights in research, experimental programs, and testing.

- (a) Most records on present or past students are subject to the requirements of [section 444](/cfr/34/444.md) of GEPA and its implementing regulations in [34 CFR part 99](/cfr/34/part99.md). ([Section 444](/cfr/34/444.md) of GEPA ([20 U.S.C. 1232g](/usc/20/1232g.md)) is commonly referred to as the “Family Educational Rights and Privacy Act of 1974” or “FERPA”.)
- (b) Under most programs administered by the Secretary, research, experimentation, and testing are subject to the requirements of [section 445](/cfr/34/445.md) of GEPA and its implementing regulations at [34 CFR part 98](/cfr/34/part98.md); [20 U.S.C. 1232h](/usc/20/1232h.md), commonly known as the “Protection of Pupil Rights Amendment” or “PPRA”; and the Common Rule for the protection of Human Subjects and its implementing regulations at [34 CFR part 97](/cfr/34/part97.md), as applicable.
