# §160.203. Applicability.

- (a) This subpart applies to the following vessels that are bound for or departing from ports or places within the navigable waters of the United States, as defined in [33 CFR 2.36(a)](/cfr/33/2.36.md?p=a), which includes internal waters and the territorial seas of the United States, and any deepwater port as defined in [33 CFR 148.5](/cfr/33/148.5.md):
  - (1) U.S. vessels in commercial service, and
  - (2) **All foreign vessels.**
- (b) Unless otherwise specified in this subpart, the owner, agent, master, operator, or person in charge of a vessel regulated by this subpart is responsible for compliance with the requirements in this subpart.
- (c) Towing vessels controlling a barge or barges required to submit an NOA under this subpart must submit only one NOA containing the information required for the towing vessel and each barge under its control.
