# §140.3. Applicability.


Unless otherwise stated, this subchapter applies to OCS facilities, vessels, and other units engaged in OCS activities as the term “OCS activities” is defined in [§ 140.10](/cfr/33/140.10.md). This subchapter does not apply to pipelines and deepwater ports (as the term “deepwater port” is defined in section 3(10) of the Deepwater Port Act of 1974 ([33 U.S.C. 1502](/usc/33/1502.md))). The regulations in this subchapter (parts [140](/cfr/33/part140.md) through [147](/cfr/33/part147.md)) have preemptive effect over state or local regulations in the same field.
