# §101.112. Federalism.

- (a) The regulations in 33 CFR parts [101](/cfr/33/part101.md), [103](/cfr/33/part103.md), 104, and 106 have preemptive effect over State or local regulation within the same field.
- (b) The regulations in [33 CFR part 105](/cfr/33/part105.md) have preemptive effect over State or local regulations insofar as a State or local law or regulation applicable to the facilities covered by [part 105](/cfr/33/part105.md) would conflict with the regulations in [part 105](/cfr/33/part105.md), either by actually conflicting or by frustrating an overriding Federal need for uniformity.
