# §842.79. Administrative claim; when presented.


When the Air Force is the proper agency to receive a claim pursuant to [28 CFR 14.2(b)](/cfr/28/14.2.md?p=b), for purposes of the provisions of 28 U.S.C. [2401(b)](/usc/28/2401.md?p=b), [2672](/usc/28/2672.md) and [2675](/usc/28/2675.md), a claim shall be deemed to have been presented when it is received by:

- (a) The office of the Staff Judge Advocate of the Air Force installation nearest the location of the incident; or
- (b) The Claims and Tort Litigation Division, 1500 West Perimeter Road, Suite 1700, Joint Base Andrews, MD 20762.
