# §2001.35. Discretionary declassification.

- (a) In accordance with [section 3.1(d)](/cfr/32/3.1.md?p=d) of the Order, agencies may declassify information when the public interest in disclosure outweighs the need for continued classification.
- (b) Agencies may also establish a discretionary declassification program that is separate from their automatic, systematic, and mandatory review programs.
