# §800.218. Excepted foreign state.


The term excepted foreign state means, until February 13, 2023, a foreign state that meets the criteria in [paragraph (a)](#a) of this section, and, beginning on February 13, 2023, a foreign state that meets both the criteria in paragraphs [(a)](#a) and [(b)](#b) of this section:

- (a) Is identified by the Committee as an eligible foreign state, and
- (b) Is a foreign state for which the Committee has made a determination under [§ 800.1001(a)](/cfr/31/800.1001.md?p=a).
