# §33.128. Periodic evaluation requirements.

- (a) The Secretary and the Secretary of Health and Human Services, as applicable, shall periodically evaluate the implementation of a program under a [section 1332](/cfr/31/1332.md) waiver consistent with [§ 33.108(f)(3)(iv)](/cfr/31/33.108.md?p=f-3-iv) and any terms and conditions governing the [section 1332](/cfr/31/1332.md) waiver.
- (b) Each periodic evaluation must include a review of the annual report or reports submitted by the State in accordance with [§ 33.124](/cfr/31/33.124.md) that relate to the period of time covered by the evaluation.
