# §780.309. Man-day exclusion.


[Section 3(e)(1)](/cfr/29/3.md?p=e-1) specifically excludes from the employer's man-day total (as defined in [section 3(u)](/cfr/29/3.md?p=u)) employees who qualify for exemption under [section 13(a)(6)(B)](/cfr/29/13.md?p=a-6-B). See [§ 780.301](/cfr/29/780.301.md). This man-day count is a basic factor in the application of the [section 13(a)(6)(A)](/cfr/29/13.md?p=a-6-A) exemption.
