# §471.15. Under what circumstances must a contractor be provided the opportunity for a hearing?


Before the Director of OLMS takes either of the following actions, a contractor or subcontractor must be given the opportunity for a hearing:

- (a) Issues an order for cancellation, termination, or suspension of any contract or debarment of any contractor from further Government contracts under Sections [7(a)](/cfr/29/7.md?p=a) or [(b)](/cfr/29/7.md?p=b) of the Executive Order and § [471.14(d)(1)](/cfr/29/471.14.md?p=d-1) or [(2)](/cfr/29/471.14.md?p=d-2) of this part; or
- (b) Includes the contractor on a published list of non-complying contractors under [Section 7(c)](/cfr/29/7.md?p=c) of the Executive Order and [§ 471.14(f)](/cfr/29/471.14.md?p=f) of this part.
