# §2570.157. Allocation of burden of proof.


For purposes of a final decision under [§ 2570.158](/cfr/29/2570.158.md) (Decision of the Administrative Law Judge) or [§ 2570.159](/cfr/29/2570.159.md) (Review by the Secretary), the petitioner shall have the burden of proof as to whether it meets [29 CFR 2510.3-40](/cfr/29/2510.3-40.md).
