# §1650.103. Scope.

- (a) This subpart applies to the collection of certain debts by salary offset against an employee's disposable pay.
  - (1) This subpart applies to collections by the EEOC from:
    - (i) Federal employees who are indebted to the EEOC; and
    - (ii) **EEOC employees who are indebted to other agencies.**
  - (2) **This subpart does not apply—**
    - (i) To debts or claims arising under the Internal Revenue Code of 1986 ([26 U.S.C. 1](/usc/26/1.md) et seq.), the Social Security Act [42 U.S.C. 301](/usc/42/301.md) et seq., or the tariff laws of the United States;
    - (ii) In any case where collection of a debt is explicitly provided for or prohibited by another statute (e.g., travel advances in [5 U.S.C. 5705](/usc/5/5705.md) and employee training expenses in [5 U.S.C. 4108](/usc/5/4108.md)).
- (b) Nothing in this subpart precludes the compromise, suspension, or termination of collection actions where appropriate under the standards implementing the Federal Claims Collection Act, [31 U.S.C. 3711](/usc/31/3711.md), namely, [31 CFR Parts 900-904](/cfr/31/part900-904.md); or the waiver of a debt where appropriate under 5 U.S.C. [5584](/usc/5/5584.md) or [5](/usc/5/5.md) U.S.C. 5524a.
