# §90.16. Polygraph testing prohibition.

- (a) For a State to be eligible for funding under this program, the State must meet the requirements of [42 U.S.C. 3796gg-8](/usc/42/3796gg-8.md) with regard to prohibiting polygraph testing of sexual assault victims.
- (b) An Indian tribal government or unit of local government shall not be eligible for subgrants from the State unless it complies with the requirements of [42 U.S.C. 3796gg-8](/usc/42/3796gg-8.md) with respect to its laws, policies, or practices prohibiting polygraph testing of sexual assault victims.
