# §900.177. Does the Equal Access to Justice Act (EAJA) apply to appeals under this subpart?


Yes. EAJA claims against DOI or HHS will be heard under [43 CFR 4.601 through 4.628](/cfr/43/4.601..4.628.md). For HHS, appeals from an EAJA award will be according to [25 CFR 900.165(b)](/cfr/25/900.165.md?p=b).
