# §83.57. When will the Assistant Secretary issue a decision on a re-petition request?

- (a) AS-IA will issue a decision within 180 days after OFA notifies the petitioner under [§ 83.54](/cfr/25/83.54.md) that AS-IA has begun review of the request.
- (b) The time set out in [paragraph (a)](#a) of this section will be suspended any time the Department is waiting for a response or additional information from the petitioner.
