# §700.127. Payments for acquisition of improvements.


Payments for acquisition of improvements shall be made in the following situations:

- (a) To individuals who have been denied benefits under these rules and who can prove ownership of habitations and improvements on land partitioned to the tribe of which they are not members. If the owner is deceased the payment shall be made to his or her estate. Payments under this subsection are further limited by [25 U.S.C. 640d-14(c)](/usc/25/640d-14.md?p=c), Pub. L. 93-531, [sec. 15(c)](/cfr/25/15.md?p=c).
- (b) To individuals who have been certified as eligible for relocation benefits but who at the time of certification, own a decent, safe and sanitary dwelling as determined by the Commission pursuant to [§ 700.187](/cfr/25/700.187.md) and who own habitation and improvements on land partitioned to the tribe of which they are not members.
