# §170.621. What if a Tribe doesn't perform work under a contract or agreement?


If a Tribe fails to substantially perform work under a contract or agreement:

- (a) For self-determination contracts, the Secretary must use the monitoring and enforcement procedures in 25 CFR [900.131(a)](/cfr/25/900.131.md?p=a) and [(b)](/cfr/25/900.131.md?p=b) and ISDEAA, [part 900](/cfr/25/part900.md) [subpart L](/cfr/25/subpartL.md) (appeals);
- (b) For self-governance agreements, the Secretary must use the monitoring and enforcement procedures in [25 CFR part 1000](/cfr/25/part1000.md), [subpart K](/cfr/25/subpartK.md); or
- (c) For FHWA or BIA TTP Agreements, the Secretaries will use the procedures identified in the Agreements.
