# §15.402. What happens after the probate file is referred to OHA?


When OHA receives the probate file from BIA, it will assign the case to a judge or ADM. The judge or ADM will conduct the probate proceeding and issue a written decision or order, in accordance with [43 CFR part 30](/cfr/43/part30.md).
