# §1000.815. Are there non-BIA programs for which the Secretary must negotiate for inclusion in a funding agreement subject to such terms as the parties may negotiate?


Yes, those programs, or portions thereof, that are eligible for inclusion in funding agreements under [section 403(b)(2)](/cfr/25/403.md?p=b-2) ([25 U.S.C. 5363(b)(2)](/usc/25/5363.md?p=b-2).
