# §1000.2435. Does the Equal Access to Justice Act (EAJA) apply to appeals under this subpart?


Yes. EAJA claims against the Department will be heard under 48 CFR [6101.30](/cfr/48/6101.30.md), [6101.31 (CBCA)](/cfr/48/6101.31.md?p=CBCA) and [43](/cfr/48/43.md) CFR 4.602, 4.604 through 4.628 (Department) and under the Equal Access to Justice Act, 5 U.S.C. [504](/usc/5/504.md) and [28](/usc/5/28.md) U.S.C. 2412.
