# §983.102. Housing accessibility for persons with disabilities.

- (a) **Program accessibility.** The housing must comply with program accessibility requirements of section 504 of the Rehabilitation Act of 1973 ([29 U.S.C. 794](/usc/29/794.md)) and implementing regulations at [24 CFR part 8](/cfr/24/part8.md). The PHA shall ensure that the percentage of accessible dwelling units complies with the requirements of section 504 of the Rehabilitation Act of 1973 ([29 U.S.C. 794](/usc/29/794.md)), as implemented by HUD's regulations at [24 CFR part 8](/cfr/24/part8.md), subpart C.
- (b) **Design and construction.** Housing first occupied after March 13, 1991, must comply with design and construction requirements of the Fair Housing Amendments Act of 1988 and implementing regulations at [24 CFR 100.205](/cfr/24/100.205.md), as applicable.
